1. Acceptance of Terms

By accessing or using the Sportal mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Age Requirement

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. Users under 18 must have parental or guardian consent.

3. Description of Service

Sportal is a sports team and event coordination platform that enables users to:

Create and manage sports teams and rosters
Organize and schedule pickup games and events
Communicate with team members
Track RSVPs and attendance

Sportal is a coordination tool only and does not organize, supervise, or control any sports activities.

4. Assumption of Risk and Liability Waiver

4.1 Acknowledgment of Inherent Risks

You acknowledge and understand that participation in sports and athletic activities involves inherent risks of physical injury, including but not limited to:

Sprains, strains, and fractures
Concussions and head injuries
Cardiac events
Heat-related illness
Contact with other participants, equipment, or surfaces
Unforeseen accidents and injuries

4.2 Voluntary Assumption of Risk

BY USING THIS APP AND PARTICIPATING IN ANY ACTIVITIES COORDINATED THROUGH IT, YOU VOLUNTARILY ASSUME ALL RISKS of injury, illness, death, or property damage arising from your participation, whether caused by the negligence of other participants, event organizers, venue operators, or otherwise.

4.3 Waiver and Release of Liability

To the fullest extent permitted by applicable law, you hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Sportal, its owners, officers, employees, agents, affiliates, and successors (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury that may be sustained by you or your property while using the App or participating in any activities coordinated through the App.

4.4 Indemnification

You agree to indemnify and hold harmless the Released Parties from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

Your use of the App
Your participation in any sports activities
Your violation of these Terms
Your violation of any rights of another person or entity

5. User Responsibilities

5.1 Accuracy of Information

You are solely responsible for the accuracy of all information you provide, including but not limited to:

Event details (location, time, rules)
Personal health and fitness information
Contact information

5.2 Personal Safety

You are responsible for:

Assessing your own physical condition before participating in any activity
Using appropriate safety equipment
Knowing and following the rules of any sport or activity
Evaluating the safety of any venue or location
Obtaining appropriate medical clearance if necessary

5.3 Conduct

You agree to:

Treat other users with respect
Not use the App for any unlawful purpose
Not harass, abuse, or harm other users
Not impersonate any person or entity
Not transmit spam, malware, or other harmful content

6. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Sportal does not warrant that:

The App will be uninterrupted or error-free
Any information provided through the App is accurate or reliable
Any events or activities will be safe or suitable for you
Any other users are who they claim to be

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SPORTAL BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, data, use, or goodwill
Any personal injury or property damage
Any damages exceeding one hundred dollars ($100)

This limitation applies regardless of the theory of liability and even if Sportal has been advised of the possibility of such damages.

8. Dispute Resolution

8.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.

8.2 Arbitration Agreement

Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Portland, Oregon, or at another mutually agreed location (including virtually).

8.3 Class Action Waiver

YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

8.4 Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court.

9. Account and Termination

9.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

9.2 Termination

Sportal may suspend or terminate your access to the App at any time, for any reason, without notice. You may delete your account at any time through the App settings.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. User Content and Copyright

You retain ownership of any content you upload to the App (such as profile photos). By uploading content, you grant Sportal a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for the purpose of operating the App.

You represent that you own or have the necessary rights to any content you upload and that such content does not infringe upon the intellectual property rights of any third party.

If you believe that content on the App infringes your copyright, please contact us at the email address provided below with a description of the alleged infringement.

12. Data Deletion Rights

You have the right to delete your account and associated data at any time. To delete your account:

Go to Account Settings → Privacy & Security → Delete My Account
Your personal data will be removed within 30 days
Some data may be retained as required by law or for legitimate business purposes

13. Changes to Terms

Sportal reserves the right to modify these Terms at any time. We will notify users of material changes through the App. Your continued use of the App after such changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Sportal regarding the use of the App.
